- Credit reporting is federal, so the rules governing the listing are identical either side of the border. What changes is the court whose record we check — Southport Magistrates Court on the Queensland side, Tweed Heads Local Court on the NSW side — and which free state services are available to you.
- A default from my business is showing on my personal file. Is that allowed?
- It depends on how the credit was taken out. A listing against you personally requires that you were personally liable, typically as a sole trader or under a personal guarantee. Where a company debt has been listed against an individual without that basis, the listing warrants review. We also handle commercial credit reporting separately.
- How long can a Queensland debt be pursued?
- Under the Limitation of Actions Act 1974 (Qld), a simple contract debt is generally statute-barred six years after the last payment or written acknowledgement. This is separate from the five-year credit reporting retention period and is general information, not legal advice.
- What free help is available on the Gold Coast?
- Legal Aid Queensland and Gold Coast community legal centres provide free legal help, the Office of Fair Trading Queensland handles trader conduct complaints, Lifeline Gold Coast and the National Debt Helpline (1800 007 007) provide free financial counselling, and AFCA is free. Using A OK Credit Repair is optional.
- What does credit repair cost on the Gold Coast?
- The credit file assessment is free. A OK Credit Repair works on a no win, no fee basis: potential fees are set out in writing before any fee-bearing work begins, and a success fee is payable only where an agreed successful outcome is achieved. Nothing is charged for an assessment that finds no grounds to dispute.
- How long do listings stay on a credit file?
- A default generally stays for five years from the date it was listed, a serious credit infringement for seven years, a civil judgement for five years, and repayment history information for two years. Only listings that are inaccurate, out-of-date, incomplete, irrelevant or misleading, or that were recorded unlawfully, can be removed earlier.
