- No. Every credit reporting dispute is lodged in writing with the credit provider and the credit reporting body, so the work is done by phone, email and post. There is no advantage to meeting in person, and Sydney clients are handled the same way as clients anywhere else in Australia.
- A judgement was entered against me in the Local Court — can that come off my credit file?
- Only if the listing is wrong or the judgement itself is set aside. If you were never properly served, an application to set aside the default judgement is made to the Local Court of NSW; if the court sets it aside, the credit file listing no longer reflects an accurate court record and can be disputed. Where the judgement stands and was correctly reported, it remains for five years.
- How long does a debt stay legally enforceable in NSW?
- In New South Wales the limitation period for a simple contract debt is generally six years from the last payment or written acknowledgement, under the Limitation Act 1969 (NSW). A debt being statute-barred does not by itself remove a default listing — the listing has its own five-year retention period — but it can be relevant to whether continued collection activity is appropriate. - A default generally stays for five years from the date it was listed, a serious credit infringement for seven years, a civil judgement for five years, and repayment history information for two years.
