This Privacy Policy explains the kinds of information we may collect and hold, how we collect, use, disclose and protect that information, and how you can request access or correction or raise a privacy concern.
We handle personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) where it applies, applicable credit-reporting requirements, our regulatory obligations and our contractual obligations.
1. Information we may collect and hold
Depending on your dealings with us, we may collect and hold information including:
- your name, date of birth, residential and previous addresses, telephone number and email address;
- identification information and copies of identification documents where reasonably required to verify your identity;
- credit reports, credit scores and other credit-related information;
- information about credit accounts, repayment history, financial hardship information, enquiries, defaults, court information and other credit-file entries;
- information and supporting documents relating to a correction request or dispute;
- correspondence between you, A OK Credit Repair, credit providers, credit reporting bodies and other relevant organisations;
- information you provide during an enquiry, free assessment or while we are providing services;
- signed agreements, authorities and other service documents;
- billing, invoice and payment information;
- records of communications and complaints;
- information about how you were referred to us, where applicable; and
- technical information generated when you use our website, such as IP address, browser or device information and website activity.
In some circumstances, information relevant to your matter may include health information or other information classified as sensitive information under Australian privacy law. Where applicable, we will only collect sensitive information where it is reasonably necessary for our functions and where consent or another lawful basis for collection exists.
2. Dealing with us anonymously
You may make a general enquiry without identifying yourself, or by using a pseudonym, where it is practicable for us to deal with you in that way.
However, we will generally need to know and verify your identity before we can review personal credit information, obtain information on your behalf, enter into an agreement with you, submit or manage a correction request or dispute, or otherwise provide our regulated services.
3. How we collect information
We usually collect personal information directly from you, including when you:
- contact us by telephone, email or through our website;
- request a free assessment;
- provide a credit report or supporting documents;
- complete or sign an agreement, authority or other form;
- authorise us to obtain information or act on your behalf; or
- communicate with us during a matter.
Where authorised or otherwise permitted, we may also collect information from:
- credit reporting bodies;
- credit providers;
- persons you have authorised to act for you;
- professional or other referrers;
- our authorising credit licensee; and
- other organisations reasonably relevant to the service we are providing.
Where we obtain or deal with credit information on your behalf, we will obtain any authority required for us to do so.
4. Why we collect, hold, use and disclose information
We may collect, hold, use and disclose information for purposes including:
- responding to enquiries;
- providing free assessments;
- verifying identity;
- reviewing and assessing credit-report information;
- providing credit reporting assistance;
- preparing, submitting and managing correction requests and disputes on your behalf;
- communicating with credit providers and credit reporting bodies;
- requesting, receiving and reviewing information relevant to your matter;
- following up and confirming the outcome of correction or dispute requests;
- preparing agreements, authorities, invoices and other documents;
- administering our services and client relationships;
- processing and recording payments;
- managing referral arrangements where applicable;
- handling complaints;
- maintaining records;
- preventing or responding to fraud, misuse and security incidents;
- complying with our obligations as an Authorised Credit Representative; and
- meeting applicable legal, regulatory, AFCA and licensee requirements.
We do not sell personal information or credit information.
5. Who we may disclose information to
Where reasonably necessary for the purposes described in this policy, we may disclose information to:
- credit providers;
- credit reporting bodies;
- Edward Griffith trading as Debt Management Services, our authorising Australian Credit Licence holder;
- the Australian Financial Complaints Authority (AFCA);
- ASIC, the Office of the Australian Information Commissioner (OAIC), courts, tribunals, law-enforcement bodies or other authorities where disclosure is required or permitted;
- professional advisers including legal, accounting or compliance advisers;
- service providers that assist us with email, electronic signatures, document management, website operation, communications, administration, data storage, security or other business functions;
- an authorised representative acting for you; and
- another person or organisation where you have authorised the disclosure or the disclosure is otherwise permitted or required by law.
If you ask us to refer you to another professional or service provider, we may provide information reasonably necessary to facilitate the referral with your consent or authority.
If you were introduced to A OK Credit Repair through a referral arrangement, limited information may also be provided to the referrer where reasonably necessary to administer that arrangement, but only where you have consented to that disclosure or it is otherwise permitted by law.
6. Referral arrangements
A OK Credit Repair may pay referral fees to professional introducers and may receive referral fees where a client is referred to certain separate non-credit-product professional services.
Where your personal information needs to be disclosed in connection with a referral, we will only make that disclosure with your consent or where otherwise permitted by law.

7. How we hold and protect information
Personal information may be held electronically through secure business systems and service providers and, where necessary, in physical records.
We take reasonable administrative, technical and organisational measures to protect personal and credit-related information from misuse, interference, loss and unauthorised access, modification or disclosure.
These measures may include access controls, passwords and authentication, secure service providers, appropriate device and account security, and restricting access to information to those who reasonably require it.
No electronic system can be guaranteed to be completely secure. If a data breach occurs, we will assess and respond to it and make any notifications required under applicable Australian law.
8. Electronic signing, email and overseas processing
We use third-party technology providers to operate our business.
Where we use Annature for electronic signing and document management, Annature states that personal and document data under its control is stored in Australia. Some limited operational processing may involve third-party service providers.
Our email service is currently provided through Titan. Titan publishes a list of subprocessors that may support its services in countries including the United States, Canada, Spain and Estonia. As a result, some personal information or service data associated with email communications may be processed by service providers located outside Australia.
Complaints received by A OK Credit Repair are handled in Australia by A OK Credit Repair and, where applicable, our authorising credit licensee, Debt Management Services. However, where a complaint or other communication is sent by email, associated email or service data may still be processed through technology providers as described above.
If we introduce or materially change a service provider in a way that means personal information is likely to be disclosed to an overseas recipient, we will update this policy where practicable to identify the relevant countries.
Where applicable, we take reasonable steps in relation to the protection of personal information disclosed to overseas recipients.
9. How long we keep information
We retain personal information for as long as reasonably necessary to:
- provide and administer our services;
- maintain appropriate business and client records;
- satisfy applicable legal, regulatory, AFCA, contractual and licensee requirements; and
- resolve disputes or complaints.
When information is no longer reasonably required, we will take reasonable steps to securely destroy or de-identify it where appropriate and permitted by law.
10. Accessing or correcting information we hold about you
You may ask us to provide access to personal information we hold about you or ask us to correct information you believe is inaccurate, out-of-date, incomplete, irrelevant or misleading.
We may need to verify your identity before giving access to personal information.
You do not have to use a particular form to make an access or correction request.

We will consider the complaint fairly and aim to respond within a reasonable period.
Privacy complaints received by A OK Credit Repair are handled in Australia. Where a complaint also relates to our regulated credit activities, it may be referred to our authorising credit licensee, Debt Management Services, for handling under the applicable internal dispute resolution process.
Depending on the nature of the complaint and the laws that apply, you may also have a right to raise the matter with the Australian Financial Complaints Authority (AFCA), the Office of the Australian Information Commissioner (OAIC), or another relevant external body.

12. Website, cookies and analytics
Our website may use cookies and standard website technologies for purposes such as:
- operating and securing the website;
- remembering settings;
- understanding how the website is used; and
- improving website functionality and performance.

Where third-party analytics or similar services collect personal information, their own privacy terms may also apply.
13. Marketing communications
Where permitted by law, we may use contact details to send information about A OK Credit Repair's services or relevant business updates.
You may opt out of marketing communications at any time by using an unsubscribe facility where available or by contacting us.
We do not use information contained in your credit report for unrelated direct marketing.
Communications that are reasonably necessary to respond to your enquiry or administer an existing assessment, agreement or matter are not treated as marketing communications.

We may update this Privacy Policy when our services, systems, service providers or legal and regulatory obligations change.
The current version will be made available on our website and will show the date it was last updated.
