- My payments slipped during a roster gap. Can those markers be removed?
- Only if they are wrong. Repayment history information is a factual record of whether a payment was made on time, and an accurate late marker stays for two years. Where the lender's own records show the payment was made within the window, or where an agreed hardship arrangement should have been reflected, the information may be inaccurate and can be disputed.
- Which court would a Hunter judgement be in?
- Usually the Local Court of NSW at Newcastle, or a nearby registry such as Belmont, Toronto, Maitland or Cessnock, with larger claims in the District Court at Newcastle. We obtain the court record and compare it with the published listing before advising whether there are grounds to dispute.
- How long can a debt be pursued in NSW?
- Under the Limitation Act 1969 (NSW), a simple contract debt is generally statute-barred six years after the last payment or written acknowledgement. That is separate from the five-year credit reporting retention period for a default. This is general information, not legal advice.
- Do I have to travel to Sydney for this?
- No. Credit reporting disputes are lodged in writing with the credit provider and the credit reporting body, so the entire process runs by phone, email and post. Newcastle and Hunter clients are handled exactly as Sydney clients are.
- What does credit repair cost in Newcastle?
- The credit file assessment is free. A OK Credit Repair works on a no win, no fee basis: potential fees are set out in writing before any fee-bearing work begins, and a success fee is payable only where an agreed successful outcome is achieved. Nothing is charged for an assessment that finds no grounds to dispute.
- How long do listings stay on a NSW credit file?
- A default generally stays for five years from the date it was listed, a serious credit infringement for seven years, a civil judgement for five years, and repayment history information for two years. Only listings that are inaccurate, out-of-date, incomplete, irrelevant or misleading, or that were recorded unlawfully, can be removed earlier.
